Thomas Michael Pouch and his wife are suing a contact solution manufacturer and Wal-Mart after Pouch suffered an eye infection from using the contact solution. Pouch claims that he has always trusted Wal-Mart’s vision center for all of his vision needs. When the staff recommended the solution, he did not think twice about any harmful side effects that might result by using the product.

Not long after begining to use the new solution, Pouch began to have pain and loss of vision in his right eye. When he returend to the vision center at Wal-Mart, the doctor diagnosed him with Fusarium Keratitis, an infection of the eye. It was not until this point that Pouch was made aware of the problems associated with the specific brand of contact solution that he was using.

Pouch is suing Wal-Mart for recommending the contact solution without fully informing him of the dangers of using the product. He is seeking damages for loss of vision, medical expenses, loss of earning capacity, legal fees, and physical impairment.
