After losing eye, Texas Woman initiates second suit

Nancie Drake, a Marshall, Texas resident in Upshur County filed a second product liability suit against Bausch and Lomb for its contact lens solution.

Her first suit concerning ReNu with MoistureLoc was dismissed without prejudice from the multi-district litigation. The second suit involving Bausch and Lomb’s ReNu with Multiplus soft contact lens solution was filed in the Marshall Division of the Eastern District of Texas on November 29.

She states that she lost sight in her eye due to the infection the solution caused and eventually, her eye was removed. She believes if she had been warned by Bausch and Lomb of the symptoms or severity of the possible injury her eye infection might have responded to medical treatment.

It is claimed that ReNu with multiplus was either defective in its chemical composition or defective through contaminants introduced during the manufacturing process.

Her complaint sets out that Bausch and Lomb committed acts of negligence and failed to warn about all possible side effects and misrepresented the risks or danger of use. The defentants did not remove the product from the market and continued to sell the solution even though the FDA notified the healthcare industry about a recall of the product in November 2006. The defendant’s conduct constitutes gross negligence. Ms. Drake is seeking punitive damages and well as damages for medical expense, pain, mental anguish, lost earning capacity, impairment, disfigurement, pre and post-judgment interest and costs of suit.

Judge T. John Ward will preside over the case. Ms. Drake is represented by several Corpus Christi and Longview attorneys. A jury trial has been requested.
